1. Who We Are
Checkmate is an education technology platform operated by Simovia, Inc., a Delaware corporation.

2. Eligibility
- Checkmate accounts must be created by parents/guardians age 18 or older.
- Children may not create accounts directly.
- By creating an account, you confirm you are authorized to manage your child's information.
3. Accounts and Invited Users
- Parents/guardians may invite trusted users (e.g., teachers, tutors, mentors, family members).
- Invited users may view and upload work but cannot invite others.
- Parents are responsible for all invited users' actions on the account.
4. Payments
- Checkmate is currently free to use.
- We may introduce paid features or subscriptions in the future, using Stripe as our payment processor.
- If payments are introduced, we will provide notice and updated terms before charging.
5. Permitted Use
You agree not to:
- Upload unlawful, harmful, or infringing content.
- Harass, exploit, or harm others using the App.
- Reverse-engineer, copy, or interfere with Checkmate's systems.
6. Intellectual Property
- All software, features, and design of Checkmate belong to Simovia, Inc.
- You retain ownership of homework and portfolio content you upload.
- By uploading, you grant Simovia a limited license to process and display content within the App.
7. Privacy
Your use of Checkmate is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
8. AI Services Disclaimer
Checkmate uses third-party AI providers (currently OpenAI; may include Anthropic and Grok in the future) to generate educational feedback.
- We use zero data retention settings where available.
- AI outputs may contain errors or biases. They are advisory only and not a substitute for professional teaching.
9. Service Availability
- We may change, suspend, or discontinue Checkmate at any time.
- While we aim for reliability, we do not guarantee uninterrupted service.
10. Limitation of Liability
To the fullest extent permitted by law:
- Simovia is not responsible for indirect, incidental, or consequential damages.
- Our total liability is limited to the greater of $50 or the amount paid by you to us in the past 12 months.
11. Termination
- You may stop using Checkmate at any time.
- We may suspend or terminate accounts that violate these Terms.
- Upon termination, your and your child's data will be immediately deleted.
12. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Delaware.
- Disputes will be resolved by binding arbitration under the rules of the American Arbitration Association, unless prohibited by law.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice.
