•Who we are: Checkmate is an app by Simovia, Inc., a Delaware company.
•Who can sign up: Only parents/guardians (18+) can create accounts. Kids don't log in directly.
•Who else can join: Parents can invite trusted people (teachers, tutors, family). They can see and upload work, but they can't invite more people.
•Privacy: We protect your data and delete your child's work if you close your account. See our Privacy Policy for details.
•Payments: The app is currently free. In the future, we may add paid features, and we'll tell you before charging anything.
•AI feedback: We use AI to help analyze student work. Sometimes it may make mistakes, so it's meant as guidance, not as a substitute for teachers.
•Rules: Use Checkmate responsibly. Don't upload harmful content or misuse the platform.
•If something goes wrong: We're not responsible for damages beyond $50 or what you've paid in the last year.
•Disputes: Any disagreements will be handled through Delaware law and binding arbitration.

Checkmate is an education technology platform operated by Simovia, Inc., a Delaware corporation.

Checkmate accounts must be created by parents/guardians age 18 or older.
Children may not create accounts directly.
By creating an account, you confirm you are authorized to manage your child's information.

Parents/guardians may invite trusted users (e.g., teachers, tutors, mentors, family members).
Invited users may view and upload work but cannot invite others.
Parents are responsible for all invited users' actions on the account.

Checkmate is currently free to use.
We may introduce paid features or subscriptions in the future, using Stripe as our payment processor.
If payments are introduced, we will provide notice and updated terms before charging.

You agree not to:

All software, features, and design of Checkmate belong to Simovia, Inc.
You retain ownership of homework and portfolio content you upload.
By uploading, you grant Simovia a limited license to process and display content within the App.

Your use of Checkmate is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

Checkmate uses third-party AI providers (currently OpenAI; may include Anthropic and Grok in the future) to generate educational feedback.

We use zero data retention settings where available.
AI outputs may contain errors or biases. They are advisory only and not a substitute for professional teaching.

To the fullest extent permitted by law:

Simovia is not responsible for indirect, incidental, or consequential damages.
Our total liability is limited to the greater of $50 or the amount paid by you to us in the past 12 months.

These Terms are governed by the laws of the State of Delaware.
Disputes will be resolved by binding arbitration under the rules of the American Arbitration Association, unless prohibited by law.

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice.
